JUNG S.A.S., a simplified joint-stock company who is registered in the Register of Commerce et des Sociétés de Paris under number 804 049 476 (hereinafter “Back Market Business,” “us,” “we,” or “our”) provides a platform under the name "Back Market Business" whose purpose is to bring together professional buyers and sellers of refurbished electronics together on a single, dedicated platform (hereinafter referred to as the "Platform").
This privacy policy describes how Back Market Business collects, uses, and shares information when you, a user, visit the Back Market Business websites available under the domaine names https://pro.backmarket.fr/ and https://pro.backmarket.co.uk/ (“Site”) or use the Platform services (hereinafter the “Privacy Policy”).
By navigating our Site dedicated to professional buyers, you agree to accept this Privacy Policy. The Site is not intended for individuals under the age of 18.
This Privacy Policy applies to data and information we collect on the Site, in email, text, and other messages between you and Back Market Business, and when you interact with our marketing or advertising and applications on third-party websites and services. Capitalized terms shall have the meaning set forth in this Privacy Policy.
The term “Personal Data” hereinafter means any information relating to an identified natural person or one who could be identified, directly or indirectly, especially by reference to an identifier, such as a name, an identification number, localization data or an online identifier.
In the scope of providing services related to the Platform, we collect and process Personal Data regarding users in order to manage the contractual relationship. In this context, we have set up data processing in accordance with the GDPR and other applicable state privacy policy statutes for the purpose of management of customer information (including the management of contractual relationships, orders, delivery, invoices, accounting, and monitoring the contractual relationship) that will allow functions required for navigation on our Platform.
- Identification Information you provide to Back Market Business when you, as a Professional Buyer, create an Account or place an Order on the Platform which may include your company business legal name, contact details such as: name, title, email address; the professional Buyer’s VAT number, state issued ID, billing and delivery address, telephone numbers, username and password, bank account and payment card details, feedback and survey responses, details about payments to and from you and other details of Products and services you have purchased from us, including but not limited to issues with previous Orders (“Identification Information”). Such Identification Information may include Personal Data, such as contact details that includes the name and surname of a Professional Buyer or Sellers’ related to employee or legal representative.
- Your end customers' data (name, shipping address) you provide to Back Market Business, when the Product you purchased on the Platform as Professional Buyer is to be delivered by the Professional Seller directly to your end customers. In this scenario, Back Market Business and the Professional Seller will process the personal data of the Professional Buyer's end-customers on behalf of the Professional Buyer, within the meaning of the applicable regulations. As a result, the Professional Buyer, as a data controller, and Back Market Business and the Professional Seller, as subprocessors, agree to adhere to a data processing agreement, which they will negotiate and complete together.
- Automatic Technical Information which may include web browser, IP address, time zone and location settings, operating system and platform, as well as information about how you use our Site, Products and services (“Automatic Technical Information”).
- Marketing and Advertising Information which may include your preferences in receiving marketing collateral from us and our third parties and your communication preferences (“Marketing and Advertising Information”).
- Aggregated Information including statistical or demographic data which may be obtained from Personal Data (“Aggregated Information”). In circumstances where Aggregated Information can directly or indirectly identify you, it will be treated in accordance with this Privacy Policy.

You can also ask us to provide you with the Personal Data you have given us in a structured and machine-readable format, which is known as the right to portability.
